Terms of Service

These Terms of Service ("Terms") govern your use of tutoring services provided by ACE Education Tutoring ("ACE Education Tutoring," "we," "us," or "our"), ABN 68677058481. By enrolling in, booking, or paying for any class or session with us, you ("you," "the client," "the parent/guardian," or "the student") agree to be bound by these Terms.

ACE Education Tutoring provides individual and small-group tutoring for primary and secondary school students, including VCE subject tutoring, Years 7 to 10 academic support, NAPLAN preparation, and selective-entry and scholarship exam preparation.

Fees are set at enrolment and may vary by class type, number of enrolled group classes, payment schedule and any approved percentage discount. Current fees are provided privately before enrolment and shown in the ACE Portal. Group class fees are calculated as one combined weekly amount across enrolled group classes.

• Group classes are billed as a single combined weekly fee based on the table in Section 2.
• There are no refunds or credits for missed group classes, regardless of the reason for the absence (illness, holidays, school commitments, or otherwise).
• We recommend students catch up on missed content via any materials or notes provided by their tutor, where available.

• Individual tutoring is billed as a regular weekly fee through the selected payment schedule.
• Approved cancellation refunds are recorded as account credit and applied to the next payment period.
• Account credits are non-transferable unless we agree otherwise in writing.

Individual sessions may be cancelled or rescheduled subject to the following notice periods. Approved amounts are credited toward the next payment period and are not returned to a bank account:

• "Notice" is calculated from the time we receive written notice (email, text, or through our booking system) to the scheduled start time of the session.
• No-shows without any notice will be treated as a same-day cancellation for the purposes of this table.
• Cancellations initiated by ACE Education Tutoring (for example tutor illness or unavailability) will always be refunded at 100% credit or rescheduled at no cost, at the client's preference.

• Fees are due in accordance with the payment schedule communicated at enrolment (for example weekly for the start of the week, fortnight, month, term or year).
• We reserve the right to suspend a student's place in a class or pause private sessions if payment is overdue.
• All fees are quoted in Australian dollars (AUD) and are inclusive of any applicable taxes unless stated otherwise.

• Enrolment in a class is confirmed once the applicable payment arrangement has been accepted.
• Students and parents/guardians agree to provide accurate contact, academic, and (where relevant) medical or learning-support information to help us deliver appropriate tutoring.
• We expect respectful conduct from all students, parents, and guardians toward tutors and staff. We reserve the right to refuse or discontinue service to any client for abusive, unsafe, or disruptive behaviour, with any account credit handled in line with Section 4.

We may, from time to time, need to change class times, group compositions, or assigned tutors due to operational requirements. We will provide reasonable notice of any such change where practicable.

All teaching materials, worksheets, practice exams, and resources provided by ACE Education Tutoring remain our intellectual property (or that of our licensors) and are provided for the personal educational use of the enrolled student only. They may not be reproduced, sold, or redistributed without our written permission.

To the maximum extent permitted by law:

• ACE Education Tutoring provides tutoring support services and does not guarantee specific academic results, grades, or exam outcomes.
• We are not liable for indirect or consequential loss arising from your use of our services.
• Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you under the Australian Consumer Law or any other law that cannot lawfully be excluded.

Either party may end the tutoring arrangement at any time by giving written notice. Any account credit will be handled in accordance with Section 4.

We may update these Terms from time to time. Updated Terms will be posted on our website with a revised "last updated" date, and continued use of our services after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of Victoria, Australia, and the parties submit to the non-exclusive jurisdiction of the courts of Victoria.
